-In the EU the ECJ has been quite rigorous against violation of personal data protection under EU law as shown in the Schrems case. -Under EU law data transfer to the third countries without appropriate level of data protection is prohibited, of which US or Japan as well. -In the TTIP negotiation, data protection topic is one of the controversial question over which US and EU are difficult to agree.. -TPP reflects the American stance and it does not require data localization, although the US participation is now gray. -Through and as a result of Japan-EU EPA negotiation, Japan is facing a human right issue, personal data protection, to be included in trade issues and is being forced to reconsider its own approach toward it. |
